Xbox 360 Live?

Do you need to xbox live to play custom games online. because my friend lives somewhere else and we want to play online in custom games together. He plugs the ethernet cord in. But we still cant play in custom games together. he doesnt have an xbox live card. But all we want to do is play together in custom games not matchmaking. Do you still need an xbox live card. We each have a console but live different places. HELP!!
